• My car was damaged by a fallen tree

    What happen if my car was damaged by a fallen tree?  Do I get to claim for my damages?  While, that depend if on your car insurance coverage, is it a third party or comprehensive?  If it is a third party policy, you cannot claim for damages from your insurer as Third Party Policy does not cover repair / damages to your own vehicles.  If you have a comprehensive policy, you are still not able claim from your insurer UNLESS you have included additional coverage for:

    • Special Perils such as Flood, Windstorm, Rainstorm, Typhoon, Hurricane, Volcanic Eruption, Earthquake, Landslide, Landslip or Subsidence

    Additional coverage premium for Special Perils would only cost 0.5% of your coverage sum insured.  So, a sum insured amount of RM80,000.00 would cost Rm400 per annum.

    If you have this additional coverage, then you can claim for the damages.  Otherwise, you will have to bear the cost of repair on your own.

    In the event that you did not include this special perils coverage, you can try seeking compensation from local council if  you are able to prove there are elements of negligence on their part for not pruning the trees.  In any cases, you will need to fork out money to repair your car first and hopefully you succeeded in recovering from the local council.

    However, if the tree is in a compound of a private property, then you cannot go against the local council, but claim your loss from the owner of the property where the tree was planted.
